Nanapp Terms of Use

Welcome to Nanapp. These Terms of Use (the "Terms") govern your access to and use of the Nanapp mobile application and the services it offers.

By downloading, installing or using Nanapp, you accept these Terms in full. If you do not agree with any of them, please uninstall the app and do not use it.

1. Who we are

Nanapp is developed and maintained by Pablo Lozano Tercero (referred to as "we"), with a contact address at [email protected].

2. Minimum age

Nanapp is intended exclusively for people over 18 years of age.

By using the app, you declare that you are at least 18 years old. If you are a minor, you must not use Nanapp or provide any information in it.

Nanapp is an application that uses artificial intelligence (AI) to generate personalised lullabies. The adult user provides a few keywords or the baby's name, and the app generates lyrics and a sung melody for them.

If we detect any of these uses, we may suspend or terminate your access to the service without prior notice.

6. Content moderation

To keep Nanapp safe and suitable for babies and children, when you add your own word (a custom word), our system moderates it automatically using AI before allowing it. If the word is considered inappropriate, it will not be accepted and you will be notified within the app.

Despite moderation, lullabies are generated by AI and we may not detect every inappropriate case. If you receive a lullaby with content you consider improper, please let us know at [email protected] so we can improve our filters.

7. Ownership of the generated lullabies

The lullabies generated with Nanapp are for your personal use and that of your close circle. We grant you a non-exclusive personal-use licence over the lullabies you create using the app.

For the musical component generated by ElevenLabs, the licensing policy of their paid plan in force at any given time applies, which permits commercial use of the generated content on Starter plans or above. We maintain a plan that enables that licence and pass it on to you as the end user.

8. Free plan and Plus subscription

8.1. Free plan

When you install Nanapp you receive 2 free lullabies to try the service: the first is created during initial setup and the second whenever you like. They are complimentary and do not count towards the monthly Plus quota.

Once these 2 free lullabies are used up, a Plus subscription is required to create more. The free version keeps access to already-generated lullabies so you can play them at any time.

8.2. Plus subscription

Plus is the paid tier of Nanapp. It includes up to 30 lullabies a month and access to all the app's features. There are three purchase options:

Prices are shown here for reference in euros (EUR); your local price is set and displayed by the App Store or Google Play for your region.

Monthly quota: the Plus subscription includes a maximum of 30 lullabies a month. When you reach that cap, generating new lullabies is blocked until the monthly quota resets (which happens each month on the date matching your subscription start); you keep access to all already-created lullabies. The quota is enforced on our servers using anonymous counters tied to your anonymous device identifier, described in our Privacy Policy. If we were to change this quota in the future, we would notify you at least 14 calendar days in advance in accordance with Section 8.5.

Abuse prevention: regardless of the monthly quota, we reserve the right to apply additional limits if we detect abnormal use or attempts to abuse the service (automated use via bots or scripts, mass account sharing between multiple people, clear attempts to overload the service, etc.). In individual cases of clear abuse we may apply immediate limits in accordance with Section 5.

8.3. Free trial period

Plus and Plus Pack include a 3-day free trial when first activated. During the trial:

Important — one trial per user: Apple and Google manage trial periods at the account level. You can only enjoy one trial per "Plus" subscription group. This means that if you activate the trial with Plus and later switch to Plus Pack (or vice versa), you will not be granted a new trial: you will be charged directly for the new plan.

8.4. Cancellation, plan changes and refunds

Subscriptions are managed through the App Store (iOS) and Google Play (Android). You can cancel or change plan at any time from your Apple or Google account settings.

Cancellation:

Switching between Plus and Plus Pack: you can switch from Plus to Plus Pack (or vice versa) at any time from your Apple or Google account settings. The platform applies proration automatically: you keep the access already paid for, and the change takes effect according to each platform's rules. As noted in Section 8.3, switching plans does not grant a new trial period.

8.5. Changes to prices and quotas

We reserve the right to change prices or quotas (up or down) to keep the service technically and economically viable. Any change will be communicated at least 14 calendar days in advance.

If we change the price of an already-active subscription, it will apply only to subsequent renewals; the currently billed period keeps its original price.

9. Service availability

Nanapp is provided "as is" and "as available". Although we do everything we can to keep the service running continuously, we do not guarantee:

Lullaby generation depends on the availability and correct operation of third-party services (Anthropic and ElevenLabs). If those services suffer interruptions, Nanapp may not work until they are restored.

10. Limitation of liability

To the maximum extent permitted by applicable law, our total liability to you for any damage arising from the use of Nanapp is limited to the amount you have paid for the app in the 12 months before the event giving rise to the claim.

11. Changes to the service and the Terms

11.1. Changes to the service

We may modify, update or discontinue Nanapp features at any time. When a change significantly affects the service, we will let you know through the app.

11.2. Changes to the Terms

We may update these Terms. When we do, we will update the "Last updated" date at the top of the document. Material changes (affecting your rights or obligations) will be notified 14 calendar days in advance through the app itself.

If you do not agree with the new Terms, you must stop using Nanapp.

12. Termination

You can stop using Nanapp at any time by uninstalling the app. That ends these Terms as far as you are concerned.

We may suspend or terminate your access if:

13. Governing law and jurisdiction

These Terms are governed by Spanish law. Any dispute that may arise in connection with these Terms will be submitted to the Courts and Tribunals of the city of Madrid, Spain, unless applicable consumer-protection law provides otherwise for consumer users residing outside Madrid.
